A woman believes an income tax-related prosecution against her was instigated by the man convicted of molesting her daughter.
|||A Durbanville mother has lodged a Western Cape High Court application to have an income tax-related prosecution against her stayed as she says it was instigated by the man convicted of molesting her daughter – fashion photographer Neil Herman.
The mother cannot be identified to protect her daughter’s identity.
In 2007, the Cape Town Regional Court found Herman guilty of sexually assaulting the girl, then aged six, and sentenced him to four years in jail. He was granted leave to appeal and sentence and was released.
In February 2010, the High Court set aside thesentence and replaced it to a R10 000 fine and a wholly suspended one-year sentence.
In an affidavit filed at the High Court, the mother said that while Herman was out on bail, he approached Sars and instigated an investigation.
The stay of prosecution application is to go to court on May 22 while the income tax case is due in July. - The Argus
