Two in court over ANCYL stalking

Two men suspected of stalking the ANC Youth League's Limpopo provincial secretary, Jacob Lebogo, have appeared in court.

Two men suspected of stalking the ANC Youth League's Limpopo provincial secretary, Jacob Lebogo, appeared in the Polokwane Magistrate's Court on Friday.

Peter Mthombeni, member of the SA National Defence Force, and Philip Nkuzana were arrested on Wednesday and charged with impersonating a police officer and possession of ammunition.

Investigating Officer Captain Risimati Baloyi told the court that Mthombeni had previous convictions while Nkuzana had a pending case against him.

Defence lawyer Jack Makgoaka disagreed with Baloyi. He said the case against Mthombeni had been withdrawn and that there was no pending case against Nkuzana.

The two have been in police custody since their arrest.

Baloyi told the court a third suspect was still at large.

He said the third accused had been seen with Mthombeni and Nkuzana on closed-circuit television (CCTV).

Baloyi said police wanted the two to identify the third man from the footage.

Magistrate Janine Ungerer warned the police not to build their case on information they may not acquire.

“You are not going to use the accused to prove your case against them,” she said.

Members of the ANC Youth League claim that Mthombeni and Nkuzana were plotting to kill Lebogo when they were arrested near the offices of the provincial department of road and transport.

Makgoaka was expected to argue that the police reflector and ammunition found in the men's possession were not in their car illegally.

The matter was postponed to February 09, 2012 for a formal bail application and for the State to prove that there was a pending case against Nkuzana. - Sapa
